Terms and conditions of sale

1. Who sells

The pieces on this site are sold by MERLIN'S ORGANISATION DI MERLIN E. E C. In the text below this is «the seller»; the buyer is «the customer».

2. What we sell

Antique furniture and objects, period and vintage pieces, and furnishings made or restored in our workshop. Almost all of them are one of a kind: what you see is what there is, and once sold it does not come back.

As most of these goods have a history behind them, marks of use, small imperfections, restorations and differences in the tone of the wood are part of their nature and are not defects. Where a mark matters we describe it in the listing and photograph it. Photographs are taken with care, but colours can vary from screen to screen.

3. Who these terms are for

They are written for the consumer: the individual buying for purposes outside their trade or profession. Those buying with a VAT number for their business are not covered by the protections of the Italian Consumer Code and in particular have no right of withdrawal as described in clause 8.

4. How the order is concluded

  • You put the pieces in the basket and go to the checkout.
  • Before confirming you see the full summary: pieces, price, shipping, any surcharges and the total to pay.
  • By confirming the order you make an offer to buy and accept these terms.
  • The contract is concluded when we send you the confirmation email, which sets out the order and serves as a receipt.

If a piece turns out to be no longer available in the meantime — it happens, with unique items — we tell you at once and refund you in full within a few days, without your having to ask.

We reserve the right not to accept orders that are incomplete, that carry plainly false details, or where payment fails.

5. Prices

Prices are in euro and include VAT. Shipping costs and any surcharges are shown separately and you see them before confirming: no cost appears afterwards.

For deliveries outside the customs and VAT territory of the European Union — including the Canary Islands, Ceuta, Melilla, Livigno, Campione d'Italia and non-EU countries — Italian VAT does not apply, while duties and taxes of the destination country are payable by the customer and are collected by the courier or customs on delivery.

Clerical price errors are possible. If a price is plainly wrong we tell you before shipping, and you are free to confirm at the correct price or to cancel with a full refund.

6. Payment

Payment is by credit or debit card, through Stripe. Card details are typed into a Stripe form and do not pass through our systems: we see only the outcome and the last four digits.

The amount is charged when the order is confirmed. If payment fails the order is not completed and the pieces become available again.

We issue an invoice on request: tick the box at the checkout and fill in your tax details before confirming, because afterwards it is no longer possible.

7. Shipping and delivery

We ship to Italy and to the countries listed at the checkout. The cost depends on the destination and on the bulk of the piece, and you see it before paying.

The times shown in the listing are estimates and run from the working days following confirmation. A large piece of furniture may need a few extra days for made-to-measure packing. In any case, as Art. 61 of the Consumer Code provides, we deliver within thirty days of the conclusion of the contract, unless otherwise agreed.

If we fail to deliver in time, you may give us a reasonable additional period; if that also passes without delivery, you are entitled to terminate the contract and to be refunded everything within a few days.

Risk passes to you on delivery, that is when you or a person you nominate take physical possession of the piece (Art. 63 of the Consumer Code). Until then, transport damage is on us.

Collection in store is also possible, with no shipping cost: choose it at the checkout and we let you know when the piece is ready.

8. Right of withdrawal: fourteen days to change your mind

If you are a consumer you have fourteen days to change your mind, without having to give reasons and without penalty. The days run from when you or a person you nominate physically receive the piece; if an order arrives in several consignments, from the last one.

To exercise it, simply tell us before the fourteen days expire, by an explicit statement: an email to info@mobilimerlin.com is perfectly sufficient. You may also use the model withdrawal form on the Returns and refunds page, but it is not compulsory.

How to return the piece, who pays for carriage and how quickly we refund is set out in full on the Returns and refunds page, which forms an integral part of these terms.

Withdrawal does not apply to the cases listed in Art. 59 of the Consumer Code, and in particular to goods made to measure or clearly personalised at your request — for instance a restoration or a finish carried out to your instructions.

9. Legal guarantee of conformity

Everything we sell to a consumer carries the two-year legal guarantee of conformity from delivery, provided for by Articles 128 to 135 of the Italian Consumer Code. It is owed by the seller, it is free of charge, and it is not to be confused with any commercial warranty.

If within two years the piece turns out not to conform to what was described, you are entitled to repair or replacement, at your choice and at no cost; if neither is possible or proportionate, to a price reduction or to termination of the contract with a refund.

In the first year the defect is presumed to have existed on delivery and it is for us to prove otherwise; in the second year the proof is on you.

What is not a defect. As these are period and second-hand pieces, the guarantee covers divergence from what we described and photographed, not the wear proper to the age of the piece. Marks, patina, small cracks in the wood, visible restorations and settling declared in the listing are features of the goods, not faults.

To claim under the guarantee write to info@mobilimerlin.com with your order number and photographs. We reply telling you how to proceed; where there is a lack of conformity, return costs are on us.

10. Support and complaints

For any problem write to info@mobilimerlin.com or call +39 0442 83002 +39 3478916852. We answer as soon as we can and in any case within five working days. If we have not replied, or the reply does not satisfy you, you may send a formal complaint to the same address: we deal with it within thirty days.

11. If we cannot agree

Before going to court an amicable solution may be attempted through an ADR body — joint negotiation, conciliation at the Chamber of Commerce, or the bodies on the list kept by the Italian Ministry of Enterprise. It is an optional route: taking it takes none of your rights away.

12. Governing law and jurisdiction

The contract is governed by Italian law. The more favourable mandatory provisions of the country in which the consumer is habitually resident continue to apply where the law of that country so provides.

For any dispute with a consumer, exclusive jurisdiction lies with the court of the consumer's place of residence or elected domicile (Art. 66-bis of the Consumer Code). In dealings with business customers, the court of Verona has jurisdiction.

13. Force majeure

We are not liable for delays or non-performance caused by events beyond our reasonable control — transport strikes, natural disasters, customs blockages, measures of the authorities. In such cases we tell you, and if the wait becomes unreasonable you may terminate the contract and be refunded in full.

14. Changes

We may update these terms. The terms that apply to your order are always those in force at the moment you confirm it, and they stay attached to the confirmation email: a later change does not touch purchases already made.

Should any clause prove void, the rest remains valid.
